This was a defective seat back case. Plaintiff was a Korean War veteran. He was 74 years old. He was driving a van southbound on the 110 freeway when another car rear ended his van. The driver's seat back broke backwards, propelling the plaintiff backwards. The top of his head struck the second row seat, causing paraplegia. The lawsuit was brought against the driver of the other car and the manufacturer of the van. The case settled for a confidential amount. Van company was contemplating bankruptcy before settlement.
