Plaintiff was a heavy machine operator. He sustained an L1 burst fracture when he lost control of the equipment allowing it to bounce violently. Plaintiff later died due to medical complications. Plaintiff's family sued the manufacturer claiming that the manufacturer failed to design the equipment with adequate safety protection during a foreseeable bouncing to protect the operator. There were no Defendants. This matter settled at an early mediation.
