Plaintiff was working on a grain auger transferring grain to feed house for a chicken farming company. Plaintiffs arm was dragged into the auger when he reached for a rag that was near the auger opening. Plaintiff lost his right arm above the elbow. Plaintiff sued the equipment manufacturer and the electronic control manufacturer. Defendants argued that Plaintiff’s comparative negligence caused his injury as he worked too close to the moving auger without turning it off. The case was settled before trial after thirty (30) depositions were taken of witnesses and experts.
