Stillman v. State of California (Stanislaus Superior Court)
Plaintiff, age 10, was crossing a roadway and was struck by an automobile. Plaintiff suffered brain damage. Litigation against the State of California was based on an alleged dangerous condition of public property due to the painting of a yellow school cross walk across an uncontrolled intersection. Defendant State made no offer. The jury made the following findings of negligence; plaintiff 2%, plaintiff's mother 5%, City of Oakdale 13%, State of California (Cal Trans) 80% and the driver 0%.
